Terms of Service

Plain-English summary: Use DocCheck honestly to track worker compliance. Your Organisation owns the data you put in. We try our best to keep the service running and secure but can't guarantee 100% uptime. Either of us can end the agreement at any time.

1. About these terms

These Terms of Service ("Terms") govern your use of the DocCheck platform at doccheck.com.au and any related services we provide (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you don't agree, please don't use the Service.

These Terms are governed by the laws of Australia.

2. Definitions

  • "DocCheck", "we", "us", "our" — the operator of the Service.
  • "Organisation" — the entity that subscribes to DocCheck to manage worker compliance (including but not limited to NDIS providers, construction firms, transport companies, aged care providers, childcare services, mining operations, and other regulated workforces).
  • "Administrator" — a person within an Organisation authorised to manage worker records and DocCheck settings. An Organisation may have multiple Administrators with equivalent privileges.
  • "Owner" — the Administrator who first signs the Organisation up to DocCheck, or whoever the Organisation later designates as the primary billing contact.
  • "Worker" — an employee or contractor of an Organisation who uses DocCheck to upload and maintain their own compliance documents.
  • "User" — any Administrator or Worker using the Service.
  • "Content" — any document, file, text, or other material uploaded to or stored within the Service, including documents uploaded by Workers (compliance evidence) and by Administrators (company forms via the Forms Hub).
  • "Subscription" — a paid recurring plan that the Organisation purchases via Stripe, granting access to the Service per the agreed tier.

3. What DocCheck is (and isn't)

DocCheck is a software tool that helps Organisations track and manage their workers' compliance documents. The Service:

  • Stores compliance documents securely (uploaded by Workers)
  • Tracks document expiry dates and sends reminders
  • Provides admin controls for approval, rejection, and review
  • Generates audit-ready compliance reports (Audit Pack)
  • Lets Administrators distribute company forms and templates to Workers (Forms Hub)
  • Records who took which action and when (decision accountability)
  • Supports multiple Administrators per Organisation

The Service is not:

  • A legal or compliance advisor — we don't tell you which documents you need to maintain or whether you're meeting your regulatory obligations. That's your responsibility.
  • A substitute for your own compliance program, policies, or record-keeping practices.
  • A verification service — we record what you upload but we don't independently verify that documents are genuine, current, or accurate.

4. Your account

Creating an account

Workers receive an invitation email from their Organisation's Administrator and create a password through the invitation link. Administrators are added by the Organisation's owner.

Keeping your credentials safe

  • You must use a strong, unique password
  • You must not share your password with anyone else
  • You are responsible for any activity on your account
  • Notify your Organisation's Administrator immediately if you suspect unauthorised access

Accuracy of information

You must provide accurate, current, and complete information. You must not impersonate another person or upload documents belonging to someone else as your own.

5. Acceptable use

When using DocCheck, you agree NOT to:

  • Upload fraudulent, forged, or altered documents
  • Upload content that is not related to your compliance obligations
  • Attempt to access another user's or another Organisation's data
  • Reverse-engineer, scrape, or interfere with the Service's operation
  • Use the Service to harass, threaten, or harm others
  • Use the Service to break any law or regulation
  • Perform automated security testing without our prior written permission
  • Resell or sub-license the Service without our written agreement

We reserve the right to suspend or terminate accounts that violate these rules.

6. Content ownership and licence

Your content

You and your Organisation retain all rights to the Content you upload. We don't claim ownership of your documents.

Our licence to operate the service

By uploading Content, you grant DocCheck a limited, non-exclusive licence to store, process, transmit, and display that Content solely for the purpose of operating the Service for you and your Organisation. We use this Content only as described in our Privacy Policy.

Our platform

The DocCheck platform — code, design, branding, documentation — is owned by DocCheck. You receive a limited right to use the Service while your account is active, but you don't acquire any ownership of the platform itself.

7. Service availability

We aim to keep the Service available 24/7, but we don't guarantee uninterrupted operation. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we'll notify you in advance where possible)
  • Unscheduled outages, including from our service providers (Supabase, Vercel, Resend)
  • Force majeure events (natural disasters, internet failures, etc.)

For paid subscriptions, specific service-level agreements (SLAs) may be agreed separately. For free or trial accounts, the Service is provided "as is" without uptime guarantees.

8. Fees and billing

Free trial

New Organisations receive a 14-day free trial from the date their account is created. No payment method is required to start the trial. During the trial period the Service is available with the same functionality as the entry-level paid plan.

Subscription plans

Paid plans are billed monthly in Australian Dollars (AUD), exclusive of GST. Stripe Tax automatically calculates and adds applicable Goods and Services Tax (GST) at checkout. Current plan tiers and prices are published at doccheck.com.au.

Payment processing

Payments are processed by Stripe Payments Australia Pty Ltd (ABN 51 600 938 137). DocCheck does not store or have access to your full payment card details. By subscribing, you agree to Stripe's Customer Terms of Service.

Automatic renewal

Subscriptions auto-renew at the start of each billing period until cancelled. You authorise DocCheck (via Stripe) to charge your nominated payment method automatically.

Cancellation

You may cancel your Subscription at any time via Settings → Billing → Manage Billing, or by contacting us. By default, cancellation takes effect at the end of the current billing period — you retain access until then.

Refunds

We do not provide pro-rata refunds for partial months. If you cancel mid-cycle, you keep access until the end of the period you paid for. Refunds in exceptional circumstances (e.g. extended service outages) are at our discretion and handled case-by-case.

Failed payments

If a payment fails, Stripe will automatically retry over the following days. We may also email the Organisation's Administrators to update the payment method. If payment remains uncollected after a reasonable retry period, access to the Service may be limited until the account is brought current. Compliance data and uploaded files remain stored throughout this period — you will not lose data due to a missed payment.

Pricing changes

We may change pricing for new or renewing Subscriptions. Existing Subscriptions on a current pricing tier will be notified at least 30 days in advance of any price increase. You may cancel before the new price takes effect if you don't wish to continue.

Trial expiry without subscription

If a free trial ends without a paid Subscription, the Organisation enters a "soft lock" state: all existing data remains visible and accessible, Workers can still log in and view their records, but new Worker invitations and new Forms Hub uploads are paused until a Subscription is started.

9. Termination

By you

You or your Organisation may terminate at any time by contacting us at support@doccheck.com.au. On termination, you can request an export of your data within 30 days.

By us

We may suspend or terminate access if you breach these Terms, fail to pay applicable fees, or engage in conduct that harms the Service or other users. We will give reasonable notice unless the breach is serious (e.g. fraud, illegal activity).

Effect of termination

After termination, we will retain compliance records as required by your industry's applicable retention obligations (typically 5–7 years for most regulated workforces — e.g. 7 years for NDIS, similar for aged care; 5 years for many workplace safety regimes). Billing records are retained for at least 7 years to comply with Australian tax law. Other data will be securely deleted within a reasonable time after the retention period ends.

10. Limitation of liability

To the maximum extent permitted by Australian law:

  • The Service is provided "as is" without warranties of any kind, express or implied, beyond those that cannot be excluded under the Australian Consumer Law.
  • We are not liable for indirect, incidental, consequential, or special damages, including lost profits, lost data (beyond reasonable recovery efforts), or business interruption.
  • Our total liability for any claim under these Terms is limited to the amount your Organisation has paid us in the 12 months preceding the claim, or $100 AUD, whichever is greater.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee or right that cannot be excluded under Australian Consumer Law.

11. Indemnity

You agree to indemnify and hold DocCheck harmless from any claim, loss, or damage arising from:

  • Your or your Organisation's breach of these Terms
  • Content you upload that infringes a third party's rights or is illegal
  • Your misuse of the Service

12. Disputes

If a dispute arises, both parties agree to first attempt to resolve it in good faith through direct discussion within 30 days of written notice.

If we cannot resolve the dispute, it will be submitted to mediation in Australia before any court proceedings are commenced (except for urgent injunctive relief).

These Terms are governed by Australian law. Courts in Australia have exclusive jurisdiction over any disputes.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be notified by email to Administrators at least 30 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
